Can a Muslim woman approach secular courts for justice?

Yes, a Muslim woman in India can approach secular courts for justice. While personal laws govern matters like marriage, divorce, inheritance, and maintenance under Muslim law, the Indian legal system allows Muslim women to seek relief under secular laws in several situations. When Can a Muslim Woman Approach Secular Courts? Divorce and Maintenance A Muslim woman can file for maintenance under Section 125 of the CrPC, which applies to all women, regardless of religion. She can also seek relief under The Muslim Women (Protection of Rights on Divorce) Act, 1986. Domestic Violence The Protection of Women from Domestic Violence Act, 2005 applies to all women, including Muslim women, allowing them to seek protection orders, residence rights, and financial support. Property and Inheritance Disputes If a Muslim woman faces injustice in property distribution, she can file a civil suit under the Indian Succession Act or Specific Relief Act in a secular court. Child Custody and Guardianship Under the Guardian and Wards Act, 1890, she can seek custody of her children in secular courts, overriding personal law in the child’s best interest. Bigamy and Women's Rights If her husband remarries without her consent in violation of Muslim law, she can challenge it in court and seek relief under civil laws. Criminal Offenses Cases like domestic abuse, harassment, or dowry-related violence can be filed under IPC sections 498A, 354, or 509 in secular courts.
