Halala is a practice under Islamic law related to divorce and remarriage, primarily in the context of Talaq-e-Biddat (triple talaq). It is intended to be a deterrent against the misuse of divorce. 1. Meaning of Halala: - Nikah Halala refers to a situation where a woman, who has been divorced by her husband through irrevocable talaq (triple talaq), marries another man, consummates that marriage, and then gets divorced or widowed before she can lawfully remarry her former husband. - It is based on the Quranic verse (Surah Al-Baqarah, 2:230): “And if he has divorced her (for the third time), then she is not lawful to him afterward until after she marries a husband other than him...” 2. Purpose of Halala: - The concept acts as a deterrent against hasty divorces. - Ensures that the divorce is taken seriously and not misused. 3. Conditions for Halala: - The woman must marry another man in a genuine marriage (not a contract marriage intended to manipulate the law). - The marriage must be consummated. - The subsequent divorce or death of the second husband should occur naturally and not be pre-planned. 4. Legal Position in India: - While Halala is recognized under Muslim personal law, the practice of conducting it as a pre-arranged agreement is considered invalid and un-Islamic. - Misuse of Nikah Halala is punishable under Indian law as it may involve exploitation, coercion, or deceit. 5. Judicial Perspective: - The Supreme Court of India has criticized the misuse of Nikah Halala and has considered cases related to its misuse under Article 14 (Right to Equality) and Article 21 (Right to Life and Personal Liberty) of the Indian Constitution.
