Can a friend or unrelated person apply for succession certificate?

Answer By law4u team

No, a friend or unrelated person cannot apply for a succession certificate under Indian law unless they have a legal interest or are authorized by a legal heir. Under the Indian Succession Act, 1925: - A succession certificate can be applied for by a person who is a legal heir of the deceased (such as a spouse, child, or parent). - It is usually issued by the district court to authorize the holder to collect debts and securities of the deceased. Exception: A friend or unrelated person may apply if: - They have a valid Power of Attorney (PoA) from a legal heir, or - They are a court-appointed guardian or executor under a Will or probate Otherwise, courts require a direct legal relationship or interest in the estate.
