Here is a detailed step-by-step explanation of the process: 1. Identify the Appropriate Consumer Forum Consumer forums in India are organized at three levels based on the value of the claim: District Consumer Disputes Redressal Commission (District Forum) For claims up to ₹1 crore. State Consumer Disputes Redressal Commission (State Commission) For claims above ₹1 crore and up to ₹10 crore. National Consumer Disputes Redressal Commission (National Commission) For claims above ₹10 crore. Choose the forum based on the value of goods or services and compensation claimed. The complaint must be filed in the jurisdiction where the opposite party resides or carries on business or where the cause of action arose. 2. Drafting the Complaint The complaint should include: Name, address, and contact details of the complainant (consumer). Name and address of the opposite party (seller, manufacturer, or service provider). Details of the goods or services purchased. Facts explaining the deficiency, defect, or unfair trade practice. Copies of bills, receipts, warranty cards, communication with the opposite party, etc. The relief or compensation sought (refund, replacement, damages, etc.). Verification and signature of the complainant. There is no need for a lawyer; consumers can file complaints personally. 3. Filing the Complaint The complaint can be filed in person or through registered post at the Consumer Forum. In many states, online filing is also available through the official consumer complaint portals. Pay the prescribed court fee, which depends on the value of the claim. The fees are nominal and fixed by each forum. --- 4. Acceptance and Notice to Opposite Party After receiving the complaint, the Consumer Forum will examine it for jurisdiction and completeness. If accepted, the Forum issues a notice to the opposite party to appear and respond within a specified time (usually 15-30 days). 5. Hearing and Evidence Both parties present their case, evidence, and witnesses during the hearings. The Forum may also direct mediation or settlement through a consumer mediation cell. 6. Final Order/ Judgment After hearing, the Forum delivers its judgment or order. If the complaint is found valid, the Forum may order refund, replacement, compensation, or other relief. The Forum’s order is binding and enforceable. 7. Appeal If either party is dissatisfied with the decision, they can file an appeal: From District Forum to State Commission within 30 days. From State Commission to National Commission within 30 days. From National Commission to the Supreme Court within 30 days. Summary: Identify the correct Consumer Forum.
