What is the time limit for filing a Second Appeal of R.T.I?

In the Right to Information (RTI) Act, there is no concept of a "Second Appeal" as such. Instead, the appeal process is structured as follows: 1. First Appeal: If an applicant is not satisfied with the response of the Public Information Officer (PIO) or does not receive a response within 30 days, they can file a First Appeal. The First Appeal must be filed within 30 days from the date of the decision or from the expiry of the 30-day response period. The First Appeal is filed with the First Appellate Authority (FAA) within the concerned public authority. 2. Second Appeal: If the applicant is still aggrieved by the decision of the First Appellate Authority or does not receive a response within 30 days of filing the first appeal, they can file a Second Appeal. The Second Appeal must be filed within 90 days from the date on which the decision should have been made or was actually received. This appeal is filed with the Central Information Commission (CIC) or State Information Commission (SIC), depending on whether the concerned public authority is under the central or state government. Summary: For the RTI Act, the time limit for filing a Second Appeal is 90 days from the date of the First Appellate Authority’s order or from when the applicant was supposed to receive a decision.

Dear Client, Under the Right to Information Act, 2005, if you are not content with the ruling of the First Appellate Authority, you may submit a Second Appeal to the Central Information Commission (CIC) or State Information Commission (SIC). Time Limit: The Second Appeal should be submitted within 90 days from the date from which the decision ought to have been passed by the First Appellate Authority or the date on which you received the decision in fact. But a delayed appeal could be accepted by the Commission if you provide adequate grounds for the delay. (See Section 19(3) of the RTI Act, 2005). I hope this answer helps.
