Court Marriage

Answer By law4u team

After a court marriage in India, the time taken to get the marriage certificate can vary depending on the local registrar office and state, but generally, it takes about 7 to 15 working days from the date of marriage registration. What Happens After Court Marriage? 1. Once the couple completes the court marriage formalities and files the application for marriage registration under the Special Marriage Act, 1954, the Marriage Registrar verifies the documents and publishes a notice for 30 days. 2. If there are no objections or disputes during this period, the Registrar schedules the marriage registration. 3. After the waiting period, the marriage is officially registered. 4. The marriage certificate is then issued by the Registrar’s office. Factors Affecting the Time Frame: Verification process of documents and identity. Whether any objections or disputes arise during the 30-day notice period. Efficiency of the local marriage registrar office. Submission of correct and complete documents. Summary: Typically, it takes around 7 to 15 working days after the 30-day notice period for the marriage certificate to be issued. In some cases, it can be faster or take a little longer depending on local administrative processes.

Dear Client, After the formal solemnization of a court marriage before the Marriage Officer, it usually takes 3 to 15 working days for the marriage certificate to be issued. This can depend on the state and local registration office. However, it must be noticed that – 1. In some states, if all the correct documents are provided during the solemnization and there is no delay in verification, then a marriage certificate may even be issued on the same day on which the court marriage occurs. 2. If there arises the need for the authorities to verify the address of the individuals or any important documents, or if there is a backlog of any kind, it may even take up to 30 days to issue the marriage certificate. Once the marriage certificate is issued, it can serve as a legally valid proof of marriage and can be used for various purposes like – visa applications, name changes, bank records, etc. I hope this answer helps. Dear Client, Under the Special Marriage Act, 1954, this is the normal procedure in a court marriage, and most frequently applied to inter-faith marriages or a simply civil ceremony. Waiting Period: There is a mandatory period of 30 days waiting period within the law. Issuance of certificates: In case there is no legal objection received within those 30 days, the marriage is solemnized and the certificate is generally given at the same date that the couple and witnesses are signing the final paper work. The approximate time taken between application and certificate is about 30-45 Days. Registration Under the Hindu Marriage Act of 1955: Waiting Period: The waiting period is normally shorter and, in most cases, a 15-day notice period is imposed after the application has been made. Issuance of certificate: Once the one week notice and document verification is done, the certificate is usually granted on the same day in which the couple and the witnesses appear before the Sub-Divisional Magistrate (SDM) or the Registrar.
