The validity of a power of attorney in India depends on the terms mentioned in the document and the purpose for which it is created. There is no fixed universal time limit unless a specific duration is stated. Under the Powers of Attorney Act, 1882 a power of attorney remains valid until one of the following events occurs. It continues until the principal revokes it, the purpose of the power is completed, the validity period mentioned in the document expires, or the principal or attorney dies or becomes legally incapable. In most cases, death of the principal automatically terminates the power of attorney. If the power of attorney is given for a specific task, it normally ends once that task is completed. If it is a general power of attorney without a time limit, it can remain valid indefinitely until revoked. However, for practical purposes, institutions such as banks or authorities may ask for a recent document or confirmation if the power of attorney is very old. If the power of attorney relates to immovable property and is registered under the Registration Act, 1908 it still does not create ownership rights but only authority to act, and its validity depends on the same conditions unless specifically revoked through proper legal process.

Dear client, The effect of the validity of Power of Attorney (POA) primarily depends upon the terms mentioned in the document and the intention of the parties. A POA is valid during the duration considered in the POA, if time limit is not mentioned, it is generally valid until revoked by the principal, or for completion of the purpose for which it was created. However, POA automatically lapses when principal dies or becomes insolvent or mentally challenged as the authority given to the agent cannot continue after principal's legal existence or capacity. In some cases like the case of an irrevocable Power of Attorney when given for consideration or coupled with the he said she did of interest, the POA may persist for the purpose agreed and cannot be highlighted without difficulty. Intimately also for practical enforceability particularly in matters relating to immovable property or legal transaction the POA must be duly stamped and, where required, registered. Therefore, validity of a POA is not fixed at the universal level but depends upon its value, compliance of law and situations affecting the principal. Dear Client, The validity of a Power of Attorney document depends on how it gets executed and its defined limits and the principal's authority which the Powers of Attorney Act 1882 allows him to maintain. A Power of Attorney document maintains its validity until the principal dies or his mental competence ends or he cancels the document or the principal dies or the purpose of the document remains active. The Powers of Attorney Act 1882 allows all instruments which grant people authority to act on behalf of a principal to receive legal recognition according to Sections 1A and 2 which establish their enforceability based on the granted powers. A Power of Attorney automatically becomes invalid upon the death, insanity or insolvency of the principal. The principal has authority to revoke the Power of Attorney whenever he wants except in cases where the Power of Attorney includes an interest, which makes it difficult to cancel following standard agency practices. The Power of Attorney needs to follow Section 17 of the Registration Act 1908 because it deals with real estate matters which require registration to establish legal rights for property transactions. A Power of Attorney which gives authority for a particular task will end when that particular task gets finished but a general Power of Attorney remains active until the person who granted it cancels it. All matters concerning its authenticity and execution and operational boundaries get resolved through examination of the document together with its accompanying records. The process of determining validity depends on three factors which include proper execution and valid authority and the absence of any revocation or upcoming incapacity.
