Errors in registered documents (like sale deeds, gift deeds, lease deeds, etc.) can be corrected in India through legally recognized procedures depending on the nature of the mistake. Under the registration framework governed by the Registration Act, 1908, corrections are not done informally; they must follow proper legal methods so that the document remains valid and enforceable. If the error is minor or clerical (such as spelling mistakes in names, typographical errors in survey numbers, or small factual inaccuracies), it can usually be corrected through a rectification deed. A rectification deed is a separate legal document executed by the same parties who signed the original document. It clearly states the mistake and the correct details, and it must also be registered with the Sub-Registrar to have legal effect. If the error is more serious or affects rights or ownership, such as wrong description of property, incorrect boundaries, or incorrect parties, the correction may still be done through a rectification deed, but sometimes it may require mutual consent of all parties and additional legal scrutiny. In disputed cases, parties may need to approach a civil court for a declaration or correction order. In situations where the original document is fundamentally defective or invalid, it may not be correctable. In such cases, a fresh registered document may be required to properly transfer or clarify rights. Dear Client, A rectification deed is referred to as a correction deed. It is an extra deed signed by the same persons who had signed the original deed, with the aim of making corrections to the original deed. This deed of rectification is required to be registered under Section 17 of the Registration Act, at the office of the same sub-registrar where the original document was registered, as it affects an already registered document. Examples of mistakes that require correction by means of a rectification deed are errors in names of parties, mistakes in survey or plot number, wrong area calculation, wrong description of land boundaries, typing mistakes in dates or amounts, and wrong khatian numbers. Both the original parties who are the seller and buyer, or donor and donee must execute and sign the rectification deed. Stamp duty on a rectification deed is generally nominal, often around 100 rupees, since it is not a fresh transfer of property but merely a correction of an existing one. However, the stamp duty applicable varies by state you can check the applicable rate in your state before proceeding. If one of the original parties has died, their legal heirs can execute the rectification deed on their behalf. If the original party is untraceable or refuses to cooperate, the alternative remedy is to file a declaratory suit under section 34 of the Specific Relief Act before the civil court, seeking a court declaration that the correct details are as you assert, after which the court decree can be used to correct the sub registrar's records. Where the error was caused by the sub registrar's office itself during registration, an application can also be made to the sub registrar under section 76 of the Registration Act for correction of clerical errors on the part of the registering authority.
