The time taken for anticipatory bail in India depends on the facts of the case and the court where it is filed under the Bharatiya Nagarik Suraksha Sanhita. Dear Client, There is no fixed statutory time frame for the disposal of an anticipatory bail application as the process is highly dependent on the complexity of the case and the urgency that is demonstrated. While the Supreme Court has encouraged lower courts to dispose of these applications within two months the practical timeline often varies from a few days for urgent cases to several weeks for a final hearing. If the case is urgent then a person can move for an interim order of protection if the court finds expedient it may grant interim bail within one to three days. Further under section 482 of BNSS if an interim order is passed the court must serve a notice to the public prosecutor and the police providing them a reasonable opportunity to be heard This process typically involves a notice period of at least seven days. Furthermore, the court is mandated by the BNSS to dispose of the anticipatory bail application within 30 days from the date of filing during the final hearing the judge will consider the nature of the accusation the criminal history of the accused the probability of him tampering with evidence and the likelihood of him fleeing from justice. In summary while a person might secure immediate interim protection in a matter of days the entire process leading to a final permanent order typically concludes within a few weeks.
