What happens if a foreign citizen commits a crime in India?

If a foreign citizen commits a crime in India, they are subject to Indian criminal law just like Indian citizens for offences committed within India. Legal basis: Constitution of India (equal protection of law under Article 14) Bharatiya Nyaya Sanhita Bharatiya Nagarik Suraksha Sanhita What can happen: Arrest and investigation in India Foreign nationals can be arrested and prosecuted for crimes committed in India. Trial in Indian courts They are tried under Indian criminal laws like any other accused person. Punishment If convicted, they may face: Imprisonment Fine Both imprisonment and fine Deportation after punishment After completing sentence (or sometimes during proceedings with legal process), they may be deported. Additional consequences: Visa cancellation or revocation Blacklisting from re-entry into India Passport seizure during investigation in serious cases Diplomatic involvement: Their embassy or consulate may be informed They may receive consular assistance, but not immunity (unless they are diplomats) Important point: Diplomatic immunity does NOT apply to ordinary foreign tourists or workers. Conclusion: A foreign citizen who commits a crime in India is fully liable under Indian law and can be arrested, tried, punished, and deported according to legal procedure.

Dear Client, If a foreign citizen commits a crime in India they are fully subject to Indian penal laws specially the Bhartiya Nyaya Sahita and other applicable statutes just as any Indian citizen would be There is no legal immunity based on nationality and ignorance of local laws is not a valid defense upon the Commission of an offense Indian law enforcement agencies have the authority to register an FIR conduct investigation and arrest the individual During this process authorities make confiscate travel documents such as passports to prevent the suspect from fleeing the country while the case is pending before the respective court. The procedural journey follows the Bharatiya Nagarik Suraksha Sahita which governs the arrest investigation and trial of the offense and arrested foreign national must be produced before a magistrate within 24 hours the magistrate then determines whether the individual should be remanded to judicial or police custody While bail may be requested the court exercises significant discretion and is less likely to grant it for serious offenses particularly if there is a perceived risk that the accused may plea or tamper with the evidence if the investigation remains ongoing detention periods can be extensive and trial processes can take several years. Beyond the criminal consequences foreign nationals convicted of offenses or those residing in India illegally face administrative action under the Foreigners Act of 1946 the central government and by delegation the state governments hold the power to detain and deport foreign nationals who violate Indian laws Deportation is a continuous statutory process and if a foreign national is sentenced to prison they must serve their term in an Indian facility before the deportation process involving the verification of nationality and issuance of travel documents can even begin.
