Here is the general process for enforcing the judgments and orders of the High Court: Decree or Order Copy: The first step is to obtain a certified copy of the decree or order from the High Court. This can be done by paying the prescribed fee and submitting an application in the registry of the court. Filing of Execution Petition: The party who has obtained the decree or order may file an execution petition in the High Court. The execution petition must specify the relief sought and the assets of the judgment debtor against which the relief may be enforced. Service of Notice: The High Court will issue a notice to the judgment debtor informing them about the filing of the execution petition and the date of the hearing. The judgment debtor may file a response to the execution petition and appear before the court on the date of the hearing. Execution Proceedings: The High Court will conduct execution proceedings and may order the seizure and sale of the judgment debtor's assets to satisfy the decree or order. The court may also order the attachment of the judgment debtor's salary, bank account, or any other income source. Disposal of Execution Petition: After considering the arguments and evidence presented, the High Court will dispose of the execution petition by either granting or rejecting the relief sought by the party who has obtained the decree or order. Civil Nature: • Under Order 21 CPC an execution petition is filed in the appropriate court which is typically the District Court or the same court where the judgment debtor resides or owns property. Enforcement Methods: • Sale and attachment of property. • Arrest and confinement to a civil prison. • Selection of a recipient. Criminal Characteristics: • The issuance of an execution warrant (e. g. 3. for a fine jail time). • For disobedience contempt proceedings may be brought. Writ orders such as certiorari and mandamus : • The court uses reports or follow-up hearings to keep an eye on compliance. • Contempt of court may be imposed for noncompliance.
