Answer By law4u team

No. Newspaper publication is not generally required for a court marriage in India. Under the Special Marriage Act, 1954, the Marriage Officer publishes a notice of the intended marriage by displaying it on the office notice board, as required by the Act. The law does not require the parties to publish a marriage notice in a newspaper. However, in certain exceptional situations, a newspaper publication may be required if: A competent court specifically directs it. It is required for a particular legal proceeding unrelated to the normal court marriage process. If no valid objection is received within the prescribed notice period and all legal requirements are fulfilled, the Marriage Officer may solemnize the marriage. After the marriage is solemnized: Both parties and three witnesses must sign the marriage register. The Marriage Officer issues the marriage certificate. Therefore, for a normal court marriage under the Special Marriage Act, 1954, publication in a newspaper is not a legal requirement. The statutory notice displayed by the Marriage Officer is sufficient.

A newspaper advertisement/publication is not a statutory requirement merely for completing a Special Marriage Act court marriage. Some people may publish one voluntarily, or a particular local practice/authority may ask for additional documentation, but it should not be confused with the statutory 30-day notice process. Also, court marriage and marriage registration are different procedures. If you tell me whether you are asking about Delhi, Noida/Gautam Budh Nagar, or another district, I can explain the exact current procedure and documents required.
