Here's how the Indian judiciary supports arbitration: Enforcement of Arbitration Agreements: The judiciary ensures that arbitration agreements are respected and enforced according to the provisions of the Arbitration and Conciliation Act, 1996. This includes ruling on the validity and scope of arbitration agreements and staying court proceedings in favor of arbitration when parties have agreed to resolve their disputes through arbitration. Appointment of Arbitrators: In cases where parties are unable to agree on the appointment of arbitrators, the judiciary can intervene to appoint arbitrators, ensuring that arbitration proceedings can commence and progress in a timely manner. Supervision of Arbitral Proceedings: While arbitration proceedings are conducted outside of the court system, the judiciary can intervene when necessary to supervise the arbitration process. This may include issuing interim measures, assisting in evidence collection, or resolving procedural disputes that arise during arbitration. Setting Aside or Enforcing Arbitral Awards: The judiciary has the authority to set aside or enforce arbitral awards in accordance with the provisions of the Arbitration and Conciliation Act, 1996. Courts may set aside awards only on limited grounds specified in the Act, such as procedural irregularities or contravention of public policy. Similarly, courts enforce arbitral awards as binding and executable judgments, providing finality to the arbitration process. Judicial Review: The judiciary also performs a limited form of judicial review over arbitral awards.
