The heart and soul of the Constitution can be considered as its fundamental principles and values. Fundamental Rights and Freedoms: Constitutions often enshrine fundamental rights and freedoms, such as the right to life, liberty, and equality, freedom of speech, religion, and assembly, and protection against discrimination. These rights are considered essential for the dignity and well-being of individuals. Separation of Powers: The Constitution typically establishes a system of separation of powers among the executive, legislative, and judicial branches of government. This separation ensures a system of checks and balances, preventing the concentration of power in any one branch and safeguarding against potential abuses. Democracy and Popular Sovereignty: Many constitutions emphasize democratic principles, affirming the power of the people to elect their representatives, participate in the decision-making process, and hold the government accountable. Popular sovereignty recognizes that the authority of the government derives from the consent and will of the people. Constitutional Supremacy: The Constitution is often considered the supreme law of the land, providing the framework for the functioning of the government and the legal system. It establishes the authority and limitations of the government, outlines the structure of governance, and sets the procedures for making laws and resolving disputes. These principles embody the spirit of the Constitution, guiding the interpretation and application of its provisions. They serve as a compass for ensuring justice, equality, and the protection of individual rights within a constitutional framework.

Among the many provisions of the Constitution, Dr. Ambedkar held one article in particular as paramount - Article 32. In the constituent assembly debates, he described it as the "heart and soul" of the Constitution, without which it would be rendered meaningless. Article 32 ensures the enforcement of Fundamental Rights enshrined in Part III of the Constitution. Article 32 in the Indian Constitution is the protector of the Fundamental Rights of the citizens of India. It is a an instrument through which an individual whose fundamental rights have been infringed can approach the Supreme Court of India to seek remedy as well as enforcement of these rights. Thus, Article 32 makes the Supreme Court both the guarantor and the defender of ‘Fundamental Rights’.
