What Is the Role of the Indian Police in Executing Extradition Requests?

Answer By law4u team

The Indian police play a crucial operational role in implementing extradition requests by locating, arresting, and facilitating the transfer of fugitives to the requesting foreign countries, all while adhering to the legal protocols established by Indian laws and the Extradition Act, 1962.

Role of Indian Police in Extradition

Locating the Fugitive

On receiving intelligence or direction from the Central Bureau of Investigation (CBI) or Ministry of External Affairs (MEA), police undertake efforts to trace and identify the whereabouts of the person sought.

Arresting the Fugitive

Indian police execute the arrest based on valid legal documents such as an arrest warrant or provisional arrest request issued under the Extradition Act.

Arrests are made in compliance with Indian criminal law and human rights standards.

Cooperation with Investigative Agencies

Police work closely with the CBI, MEA, and other central agencies to ensure coordination and smooth execution of the extradition process.

Custody and Detention

The police hold the arrested fugitive in custody safely until the extradition magistrate conducts the necessary hearings and passes orders.

Supporting Judicial Proceedings

Provide assistance to the magistrate or court during extradition hearings, including producing the fugitive in court and submitting required reports or evidence.

Ensuring Security and Preventing Escape

Ensure tight security during detention and transit to prevent escape attempts or interference with the legal process.

Example

A foreign country requests extradition of an individual wanted for financial crimes. Indian police, after receiving a provisional arrest request and valid warrant, locate and arrest the individual in Mumbai. They maintain custody and cooperate with the CBI and judicial authorities during the extradition proceedings until the fugitive is handed over.
