What Happens To Maintenance Claims If Reconciliation Fails?

Maintenance claims arise from the legal obligation to provide financial support to a spouse, child, or dependent after separation or divorce. Often, courts encourage parties to reconcile or settle disputes amicably. However, if reconciliation efforts fail, the maintenance claims must be addressed through formal legal procedures. Failure to reconcile does not nullify maintenance claims; instead, courts take necessary steps to enforce or modify maintenance orders ensuring the rights of the aggrieved party are protected.

Legal Position When Reconciliation Fails

Maintenance Claims Remain Valid

Reconciliation failure does not extinguish maintenance rights or claims. The aggrieved party retains the right to claim maintenance as per existing court orders or can file fresh petitions for maintenance.
