In India, the Consumer Disputes Redressal Commissions are consumer courts established under the Consumer Protection Act, 2019 to resolve disputes between consumers and service providers or manufacturers. These commissions are divided into three levels based on the value of the claim and the geographical location. The District Consumer Disputes Redressal Forum (DCDRC) handles local disputes, the State Consumer Disputes Redressal Commission (SCDRC) addresses state-level disputes, and the National Consumer Disputes Redressal Commission (NCDRC) deals with cases at the national level. The jurisdiction of each forum is determined by factors such as the value of the claim, the location of the consumer, and the nature of the complaint.

Jurisdiction of Consumer Disputes Redressal Commissions

District Consumer Disputes Redressal Forum (DCDRC)

  • Jurisdiction: The District Forum deals with consumer disputes involving claims up to ₹20 lakh.
  • Scope: It has jurisdiction within the district where the complaint is filed.
  • Example: If a consumer buys a defective product worth ₹10 lakh in a district and faces an issue, the District Consumer Forum of that district can hear the case.

State Consumer Disputes Redressal Commission (SCDRC)

  • Jurisdiction: The State Commission hears complaints with a value exceeding ₹20 lakh but less than ₹1 crore.
  • Scope: It has jurisdiction within the state or union territory in which it is located.
  • Example: If a consumer faces an issue with a product or service worth ₹50 lakh, they would approach the State Consumer Forum of their state or union territory.

National Consumer Disputes Redressal Commission (NCDRC)

  • Jurisdiction: The National Commission deals with cases where the value of the claim exceeds ₹1 crore.
  • Scope: It has national jurisdiction, meaning it can hear complaints from any part of the country that meets the value criterion.
  • Example: A consumer facing issues with a defective service or product valued at ₹1.5 crore would file a complaint with the National Consumer Forum.

Key Determinants of Jurisdiction

Value of the Claim

  • District Forum (DCDRC): Jurisdiction over complaints involving claims up to ₹20 lakh.
  • State Commission (SCDRC): Jurisdiction over complaints with claims between ₹20 lakh and ₹1 crore.
  • National Commission (NCDRC): Jurisdiction over complaints with claims above ₹1 crore.

Territorial Jurisdiction

The jurisdiction is also territorial in nature, meaning that complaints must be filed in the forum closest to the consumer's place of residence or where the transaction took place.

  • Example: If a consumer in Delhi buys a product from a Mumbai-based company, the consumer can file a complaint either in the District Forum of Delhi (if the claim is under ₹20 lakh) or in Mumbai, depending on the nature of the transaction.

Nature of the Dispute

The Consumer Protection Act defines consumer disputes broadly to include issues related to defective goods, deficient services, unfair trade practices, and misrepresentation. These commissions have jurisdiction over a variety of cases that affect consumer rights.

  • Consumers: The Act protects individuals who purchase goods or services for personal use.
  • Service Providers: The term service provider includes businesses, professionals, and government organizations providing services to consumers.

Procedure for Filing Complaints Based on Jurisdiction

DCDRC (District Forum)

  • How to File: The complaint should be filed in the District Forum within whose jurisdiction the respondent (defendant) resides, carries on business, or where the cause of action arises.
  • Time Limit: Complaints must be filed within 2 years from the date of the cause of action.

SCDRC (State Commission)

  • How to File: If the claim exceeds ₹20 lakh but is less than ₹1 crore, the complaint should be filed in the State Commission where the cause of action occurred or where the respondent is based.
  • Time Limit: The time limit is the same as that for the District Forum—2 years from the date of the cause of action.

NCDRC (National Commission)

  • How to File: For claims above ₹1 crore, complaints should be filed with the National Consumer Forum, which is located in New Delhi. Consumers can also file the complaint from any part of India, as the forum has national jurisdiction.
  • Time Limit: Similarly, complaints must be filed within 2 years of the cause of action.

Example of Jurisdiction Based on Claim Value

Scenario 1:

  • A consumer in Kolkata purchases a mobile phone for ₹18 lakh, and the phone malfunctions shortly after use. The consumer files a complaint in the District Consumer Forum of Kolkata, as the claim is under ₹20 lakh.

Scenario 2:

  • A consumer in Mumbai purchases a defective air conditioner worth ₹35 lakh from a well-known brand. Since the claim exceeds ₹20 lakh but is less than ₹1 crore, the consumer files a complaint in the State Consumer Forum of Maharashtra.

Scenario 3:

  • A consumer in Chennai experiences a defective solar panel installation worth ₹1.5 crore. The consumer files a complaint with the National Consumer Forum as the claim exceeds ₹1 crore.

Consumer Protection Act Amendments

With the new Consumer Protection Act, 2019, the framework for consumer dispute redress has been simplified, but the basic principle of jurisdiction based on claim value and location remains intact.

Appeals

  • If a consumer is dissatisfied with the decision of the District or State Commission, they can appeal to the higher commission (i.e., State Commission or National Commission, respectively). The National Commission’s decision can be appealed in the Supreme Court of India.
