Procedure for Filing Complaints for Product Defects

1. Collect Evidence

  • Retain the purchase invoice, warranty card, and packaging of the product.
  • Document the defect clearly by taking photographs or videos.
  • Keep records of any communication with the seller or manufacturer regarding the defect.

2. Contact the Seller or Manufacturer

  • Inform the seller or manufacturer about the defect and request repair, replacement, or refund.
  • Often, companies have customer service helplines or grievance cells to handle such complaints.

3. Write a Formal Complaint

  • If the seller/manufacturer fails to resolve the issue, draft a written complaint stating:
    • Details of the product and defect
    • Purchase details
    • Attempts made to resolve the issue
    • Relief sought (refund, replacement, or compensation)

4. File Complaint in Consumer Forum

  • Based on the value of the claim, file the complaint with:
    • District Consumer Disputes Redressal Commission (claims up to ₹50 lakh)
    • State Consumer Disputes Redressal Commission (claims between ₹50 lakh and ₹2 crore)
    • National Consumer Disputes Redressal Commission (claims above ₹2 crore)
  • Submit the complaint along with copies of all supporting documents and evidence.

5. Pay the Prescribed Fee

  • Pay the nominal filing fee as prescribed by the forum based on the claim amount.

6. Attend Hearings and Present Your Case

  • Attend hearings personally or through a lawyer to present evidence and arguments.
  • The opposite party (seller/manufacturer) will also be heard.

7. Follow the Forum’s Decision

  • The forum may order replacement, refund, compensation for damages, or repair of the defective product.
  • Compliance with the forum’s order is mandatory; non-compliance can lead to penalties.
