What is the procedure for filing complaints against fake online retailers?

Answer By law4u team

Fake online retailers exploit consumers by accepting payment for products that are never delivered. Such fraud not only causes financial loss but also undermines trust in e-commerce platforms. Indian laws like the Consumer Protection Act 2019 and IT Act 2000, along with cybercrime regulations, provide a clear framework for consumers to file complaints, seek refunds, and initiate legal action against fraudulent sellers. Timely reporting and proper documentation are crucial for resolution.

Procedure for Filing Complaints Against Fake Online Retailers

Collect Evidence

  • Save all transaction details, including payment receipts, emails, chat records, screenshots of the website, and advertisements.
  • Note the URL, seller name, transaction ID, and payment method.

Contact the Seller or Platform (If Possible)

  • Attempt to contact the seller through official emails, helplines, or the e-commerce platform’s grievance portal.
  • Request a refund or delivery confirmation and keep a record of all communications.

File a Complaint with the Bank or Payment Provider

  • If payment was made through credit/debit card, UPI, or net banking, inform the bank immediately.
  • Request a chargeback or reversal of the payment under RBI guidelines.

Report to Cybercrime Authorities

  • Lodge a report on the National Cyber Crime Reporting Portal (cybercrime.gov.in) or state-level cybercrime portals.
  • Provide all supporting evidence and transaction details to assist in investigation.

File a Consumer Complaint

  • If the platform or seller does not resolve the issue, approach the District, State, or National Consumer Dispute Redressal Commission.
  • File a formal complaint citing deficiency in service, unfair trade practices, and online fraud.

Monitor and Follow-Up

  • Keep a record of all complaint numbers, reference IDs, and correspondence.
  • Follow up regularly with the bank, cybercrime authorities, and consumer forum for updates.

Consumer Safety Tips

  • Verify sellers by checking reviews, ratings, and official business registrations before purchase.
  • Avoid deals that seem too good to be true; scammers often lure consumers with unrealistic discounts.
  • Use secure payment methods like UPI, credit cards with 2FA, or verified wallets instead of direct bank transfers.
  • Regularly monitor bank statements and digital transaction alerts.
  • Educate family members and friends about common online shopping scams.

Example

A consumer orders a smartphone from a website promising huge discounts. After making an online payment of ₹25,000, the product is never delivered, and the seller stops responding.

Steps the consumer should take

  • Collect all transaction proofs, emails, screenshots, and the website URL.
  • Contact the website/email seller requesting delivery or refund.
  • Report the unauthorized payment to the bank and request a chargeback.
  • File a cybercrime complaint on cybercrime.gov.in.
  • If unresolved, lodge a complaint with the District Consumer Dispute Redressal Commission citing fraud and deficiency of service.
  • Follow up with all authorities until refund or compensation is received.
