The State Consumer Commission is an important part of the Consumer Protection Act, 2019. It handles consumer disputes that fall within a specific monetary range and serves as a middle-tier forum for redressal. The State Commission is crucial in resolving issues related to defective goods, poor services, unfair trade practices, and other consumer-related complaints that have a significant financial value, but do not exceed the jurisdiction of the National Commission.

Jurisdiction of the State Consumer Commission

Monetary Limit for State Consumer Commission:

The State Consumer Commission can handle complaints where the value of the claim is more than Rs. 20 lakh but less than or equal to Rs. 1 crore. If the claim amount falls within this range, the State Commission has the authority to hear and adjudicate the case. For complaints involving claims above Rs. 1 crore, the matter must be taken to the National Consumer Commission.

Types of Cases Handled by the State Consumer Commission:

  • Deficiency in Service: Complaints about poor or substandard services, such as delayed deliveries, unsatisfactory repairs, or services not being rendered as promised.
  • Defective Goods: Cases where products are found to be defective or damaged, such as faulty electronics, malfunctioning vehicles, or subpar household items.
  • Unfair Trade Practices: Disputes involving misleading advertisements, false claims, or fraudulent practices by businesses designed to deceive consumers.
  • Breach of Contract: Situations where businesses or service providers fail to fulfill their contractual obligations, such as delivery of goods or provision of services.
  • Product Liability: Complaints where consumers are harmed by products that are unsafe or defective, including cases involving food poisoning, unsafe electronics, or faulty machinery.
  • Financial Disputes: Issues involving financial services, such as wrongful charges by banks or insurance companies, or disputes related to faulty investments or services.
  • E-commerce Disputes: Complaints related to online shopping, such as non-delivery of goods, fraudulent sellers, or defective products purchased from online platforms.

State Commission's Role in Consumer Redressal

The State Consumer Commission is the first appellate authority for complaints that are filed at the District Consumer Forum within the state. If a consumer or a service provider is dissatisfied with the decision made by a District Forum, they can appeal to the State Consumer Commission. This forum is tasked with resolving more complex disputes that require a higher level of authority than what the District Forum can provide.

Handling Appeals:

If a party is unsatisfied with the ruling of the State Consumer Commission, they can appeal to the National Consumer Commission. However, if the complaint is below Rs. 1 crore and pertains to an issue within the state, the decision made by the State Commission will generally be final.

State Consumer Commission vs. District and National Forums

The State Consumer Commission is situated in between the District Forum and the National Commission in terms of jurisdiction and monetary limits.

  • District Consumer Forum: This forum handles disputes where the claim amount is up to Rs. 20 lakh. It deals with smaller consumer grievances and provides quick redressal at the local level.
  • State Consumer Commission: The State Commission has the authority to handle complaints where the claim exceeds Rs. 20 lakh but is less than or equal to Rs. 1 crore. It also hears appeals from the District Forum.
  • National Consumer Commission: The National Commission handles disputes where the claim amount is above Rs. 1 crore and also acts as an appellate authority for decisions made by State Consumer Commissions.

Examples of Cases Under State Consumer Commission Jurisdiction:

  • Defective Product: A consumer buys an expensive luxury car worth Rs. 70 lakh, but the car is found to have a defective engine. The consumer approaches the State Commission for a remedy since the claim is greater than Rs. 20 lakh but less than Rs. 1 crore.
  • Medical Negligence: A patient seeks compensation for medical negligence after undergoing treatment at a private hospital. The compensation claimed is Rs. 50 lakh. This case would fall under the jurisdiction of the State Consumer Commission as it exceeds Rs. 20 lakh but is below Rs. 1 crore.
  • E-commerce Dispute: A consumer orders high-end electronics online for Rs. 40 lakh, but the product delivered is damaged and the seller refuses to offer a replacement. The consumer can file a complaint in the State Commission, as the value of the goods is within the State Commission’s jurisdictional limit.
