Before filing a complaint, it's essential to understand what qualifies as an unfair trade practice. The Consumer Protection Act, 2019, defines several unfair practices, including:

  • Misleading Advertisements:

Process for Filing a Complaint Against Unfair Trade Practices

  1. Collect Evidence of Unfair Trade Practices:

    Documentation is crucial to support your complaint. Gather as much proof as possible, such as:

    • Advertisements, brochures, or other promotional materials.
    • Receipts, invoices, or transaction details showing the deceptive claims.
    • Photographs or videos of the product or service that prove its substandard quality or deceptive nature.
    • Expert opinions or reports (if necessary) regarding the defects or misrepresentations.
  2. Contact the Business or Seller:

    Before filing a complaint with the Consumer Forum, it’s recommended to first reach out to the business or service provider and raise the issue. Write a formal complaint highlighting the unfair trade practice, detailing how you were misled or wronged.

    If the business does not respond satisfactorily, or if the issue remains unresolved, you can proceed with filing a formal complaint in the consumer court.

  3. File a Complaint with the Consumer Forum:

    Consumers can file a complaint with the Consumer Disputes Redressal Commission (CDRC). Depending on the value of the claim, complaints can be filed in:

    • District Consumer Forum (for claims up to Rs. 1 crore)
    • State Consumer Forum (for claims between Rs. 1 crore and Rs. 10 crore)
    • National Consumer Forum (for claims above Rs. 10 crore)
  4. Steps to File a Complaint:

    Draft the Complaint: Prepare a detailed complaint that outlines the unfair trade practice, how it affected you, and the compensation or remedy you seek. The complaint should include:

    • Personal information: Name, address, and contact details.
    • Details of the complaint: What unfair trade practice was committed, including product details and misleading claims.
    • Evidence: Attach all supporting documents like receipts, advertisements, product photos, etc.
    • Relief sought: Specify the compensation, refund, or other remedies you are seeking.

    File the Complaint: Submit the complaint to the appropriate Consumer Forum (District, State, or National). Ensure to file within the time frame stipulated by the Act (usually 2 years from the date of the occurrence of the unfair practice).

    Pay Filing Fee: Some forums require a nominal filing fee, depending on the value of the complaint.

  5. Wait for the Hearing:

    After the complaint is submitted, the Consumer Forum will schedule a hearing. Both parties will be given an opportunity to present their side. If the seller or business is found guilty of unfair trade practices, they may be ordered to:

    • Cease the unfair trade practice.
    • Refund the consumer's money or replace the defective product.
    • Pay compensation for any losses or damages suffered by the consumer, including emotional distress, medical costs, or financial loss.
    • Public apology or a retraction of misleading advertisements.
  6. Appeal Process:

    If the consumer is not satisfied with the decision of the District Forum, they can appeal to the State Consumer Forum. Similarly, if the consumer is dissatisfied with the State Forum’s decision, they can file an appeal with the National Consumer Forum.

  • Refund or Replacement: If the product or service was misrepresented or deficient, the consumer can demand a refund or a replacement of the product or service.

  • Punitive Damages: If the business’s actions were particularly egregious or involved willful negligence, the Consumer Forum can impose punitive damages to deter the business from repeating the misconduct.
  • Public Apology and Corrective Action: The forum may order the business to issue a public apology and take corrective actions, such as withdrawing misleading advertisements or correcting false claims in the marketplace.
  • Consumer Education: The forum may direct the business to educate consumers about the product's real features and stop misleading advertising practices.

  • Case: A consumer purchases a premium mobile phone based on a misleading advertisement claiming it has a 4K camera and extended battery life. Upon use, the consumer discovers that the camera is of substandard quality and the battery drains rapidly.
  • Steps Taken:
