Can consumer complaints be filed for misleading product labels?

Product labeling is an essential component of consumer protection, as it provides critical information about the product, such as ingredients, usage instructions, nutritional value, and expiry dates. However, misleading labels, whether due to false advertising, incorrect details, or deceptive claims, can confuse or deceive consumers into purchasing products that do not meet their expectations. To ensure accountability and transparency, consumer protection laws provide a mechanism for consumers to file complaints against such misleading labels and seek redress.

Steps to File Complaints for Misleading Product Labels

Identify the Misleading Claim or Error

  • Consumers must first identify and verify the misleading claim or error on the label. Common examples include:
    • False advertising: Claims that are not substantiated by the actual product or service.
    • Incorrect ingredients list: Ingredients mentioned on the label that are not actually present in the product.
    • Incorrect quantity/weight: Product quantity that does not match the label or claims.
    • Health or nutritional claims: For example, claiming a product is sugar-free when it actually contains sugar.

Contact the Manufacturer or Seller

  • Before filing a formal complaint, consumers should attempt to resolve the issue by contacting the manufacturer or the seller.
  • Provide proof of the misleading label, including photographs, receipts, or packaging, and request a refund, replacement, or clarification.
  • Escalate the issue to the company’s customer service or higher management if the initial response is unsatisfactory.

File a Complaint with the Consumer Protection Helpline

  • If the company does not resolve the complaint satisfactorily, consumers can approach the National Consumer Helpline (NCH) at 1800-11-4000 or file a complaint online at https://consumerhelpline.gov.in/. The NCH helps in resolving issues with manufacturers or sellers and acts as a mediator.
  • This service can escalate the matter to a consumer forum if necessary.

File a Complaint with Regulatory Bodies

  • FSSAI (Food Safety and Standards Authority of India): For food products, if the labeling is misleading or violates the Food Safety and Standards Act, 2006, consumers can file a complaint with FSSAI. FSSAI ensures food products comply with health standards and accurate labeling.
  • BIS (Bureau of Indian Standards): For non-food products, consumers can approach the Bureau of Indian Standards (BIS) if the product fails to meet quality or labeling standards. BIS ensures that products comply with Indian standards.
  • TRAI: In case of misleading advertisements related to telecommunication services, consumers can approach TRAI (Telecom Regulatory Authority of India) for regulatory redress.

Approach the Consumer Forum

  • If all else fails, consumers can file a complaint in the District Consumer Forum (for claims up to ₹20 lakh), State Consumer Commission (for claims between ₹20 lakh and ₹1 crore), or National Consumer Commission (for claims above ₹1 crore).
  • The complaint should include details of the misleading label, a description of the product, and any financial loss or harm caused.
  • The consumer forum will review the case and issue an order, which may include compensation, a refund, or directions for corrective action.

Legal Action for Serious Violations

  • If the case involves fraudulent intentions or criminal negligence, the consumer may file a criminal case under the Indian Penal Code (IPC) for offenses like cheating (Section 420) or misleading advertising (Section 465).
  • Consumer Protection Act, 2019: Section 2(47) of the Consumer Protection Act, 2019 allows consumers to seek redress for deficiencies in services, including misleading advertising or labeling.

Regulatory Bodies and Their Role in Addressing Misleading Labels

FSSAI (Food Safety and Standards Authority of India)

  • FSSAI is responsible for regulating the labeling and advertisement of food products in India. It ensures that food labels provide accurate, truthful information that helps consumers make informed choices.
  • FSSAI regulations mandate that food products must contain:
    • Correct ingredients list.
    • Proper nutritional information.
    • Clear labeling regarding allergens, expiration date, and manufacturing details.
  • Consumers can file a complaint with FSSAI if they encounter misleading food labels or health claims that are not substantiated by the product.

BIS (Bureau of Indian Standards)

  • For non-food products, BIS ensures that goods comply with Indian standards for quality, safety, and labeling. The Bureau of Indian Standards oversees labels related to product specifications, certifications, and usage instructions.
  • BIS Certification on products ensures that they conform to the relevant quality standards. If consumers find misleading labels on certified products, they can file a complaint with BIS.

Advertising Standards Council of India (ASCI)

  • ASCI is a self-regulatory body for advertising in India. It ensures that advertisements, including those on product labels, do not mislead or deceive the public.
  • Consumers can approach ASCI for complaints about misleading advertising claims on labels, which may include false or exaggerated health claims or unsubstantiated benefits.

Legal Protections and Consumer Rights

  • Consumer Protection Act, 2019: Under the Consumer Protection Act, 2019, consumers have the right to seek compensation for any harm caused by misleading labels. Section 2(47) of the Act includes provisions for compensation in case of misleading goods or services.
  • Product Labeling Guidelines: The Food Safety and Standards Regulations, 2011 and the Food Safety and Standards Act, 2006 require food manufacturers to disclose true and accurate details of the product on the label.
  • Similarly, for non-food products, the Bureau of Indian Standards has set guidelines for correct labeling.

  • Know Your Consumer Rights: Familiarize yourself with your rights under the Consumer Protection Act, and know how to approach the relevant authorities or consumer forums if you feel you’ve been misled by a product label.
  • Seek Compensation for Losses: If you suffer any harm (e.g., health-related issues or financial loss) due to misleading labels, you can demand compensation from the company or through the relevant consumer forum.

Example

A consumer purchases a health drink claiming to be 100% natural and sugar-free, based on the label. After consumption, the consumer notices that the drink contains sugar and synthetic flavoring, which was not disclosed on the label.

Steps the consumer should take:

  • Contact the Manufacturer: Inform the manufacturer about the misleading label and request a refund or replacement.
  • File a Complaint with FSSAI: Since the product is a food item, the consumer can file a complaint with FSSAI regarding the misleading health claim.
  • Approach the Consumer Forum: If the company refuses to act, the consumer can approach the District Consumer Forum for redress and demand compensation for the misleading labeling and any harm caused.
