Under the Consumer Protection Act, 2019, consumer forums in India are classified into three levels: District Consumer Forum, State Consumer Commission, and National Consumer Commission. Each forum has a specific jurisdiction based on the value of the claim. The District Consumer Forum has a monetary jurisdiction that determines the types of consumer complaints it can handle. If the value of the complaint exceeds the District Forum’s jurisdiction, the case may be referred to a higher forum, such as the State Commission or National Commission.

Jurisdiction Limit of District Consumer Forum

  • Monetary Limit:
    • As per the Consumer Protection Act, 2019, the District Consumer Forum can entertain consumer complaints where the value of the claim is less than ₹1 crore.
    • This means that if the amount involved in the complaint, whether for defective goods, poor services, or fraud, is ₹1 crore or less, the case should be filed in the District Consumer Forum.
  • Filing Complaint in District Forum:
    • A consumer should file the complaint in the District Consumer Forum if the total compensation or claim amount is within ₹1 crore.
    • The forum handles issues like defective products, poor services, fraud, and unfair trade practices.
  • When to Approach State Commission or National Commission?
    • If the claim value exceeds ₹1 crore but is less than ₹10 crore, the State Consumer Commission should be approached.
    • If the claim value exceeds ₹10 crore, the case must be filed in the National Consumer Commission.
  • Jurisdiction Based on Type of Relief Sought:
    • The forum's jurisdiction also depends on the type of relief sought. Whether a consumer is seeking a refund, replacement, compensation for damages, or punitive damages, the District Forum handles complaints up to ₹1 crore in value.
    • If the value of the relief sought exceeds the forum’s jurisdiction, it will be transferred to the State or National Commission as per the guidelines mentioned.
  • How to Determine the Claim Value for Filing a Complaint:
    • Total Amount Involved: This includes the price of the goods or service, plus any compensation for damages, pain, and suffering, medical expenses, or loss of income.
      • Example: If a consumer paid ₹5 lakh for a car that was defective and seeks additional compensation for pain and suffering, and medical expenses due to an accident caused by the defect, the total claim will include the cost of the car plus the compensation for damages.
    • Compensation for Mental Distress or Inconvenience: If the consumer claims emotional distress or psychological harm due to a defective product or service, this amount will also be included in the total claim.
    • Punitive Damages: In cases of gross negligence, fraud, or willful harm, the consumer may claim punitive damages. These damages are intended to penalize the service provider and deter future unethical practices. Such damages should also be added to the claim value to determine jurisdiction.

Process of Filing a Complaint in District Consumer Forum

  • Filing a Complaint:
    • The consumer needs to file the complaint with the District Consumer Forum. The complaint should include:
      • Details of the service or goods provided by the seller/provider.
      • Copies of all documents (receipts, contracts, communication with the provider).
      • Evidence of defect, fraud, or service failure.
      • A detailed statement of the claim amount, including refunds, damages, and other relief sought.
  • Jurisdiction Confirmation:
    • The District Forum will assess if the claim value is below ₹1 crore. If it is, the case will proceed; otherwise, the case will be transferred to the State Commission or National Commission as applicable.
  • Hearing and Judgment:
    • The forum will schedule hearings where both the consumer and service provider can present their cases. After reviewing the evidence, the forum will issue a judgment. If the consumer’s claim is found valid, the forum may order the service provider to compensate the consumer as per the claim.

Example of Jurisdiction in Practice

  • Claim Amount: ₹80,000 (cost of the appliance) + ₹70,000 (compensation for distress and inconvenience).
  • The total claim is ₹1,50,000, which is within the ₹1 crore limit.
  • Therefore, the consumer can file the complaint in the District Consumer Forum.
