How to file a complaint for false claims on online health products?

The online health product market has grown significantly in recent years, with numerous products being marketed with exaggerated or false claims, such as miraculous cures, weight loss guarantees, or unproven health benefits. Consumers often fall victim to these deceptive marketing tactics, which not only lead to financial loss but also pose health risks. Thankfully, consumers have various legal options to file complaints and seek redressal when they are misled by false claims on health products.

Steps to File a Complaint for False Claims on Online Health Products

Contact the Seller or Platform

  • The first step is to contact the seller or online platform from which the product was purchased (such as Amazon, Flipkart, Healthkart, etc.) to report the issue.
  • Explain that the product made false claims and request a refund or return based on the misrepresentation.
  • Provide any supporting documentation, including screenshots of the advertisement, product page, or claims made about the product that are false or misleading.

Check the Return/Refund Policy

  • Most e-commerce platforms and sellers have a return and refund policy for health products, but these may vary. Review the terms and conditions to ensure you’re eligible for a return or refund.
  • If the product does not meet the claimed benefits, or is unsafe due to misleading marketing, it is reasonable to request a refund.
  • If the product is being advertised with false health claims that do not align with regulatory standards, consumer protection laws may be applicable.

Report the Seller to Consumer Protection Authorities

  • If the seller refuses to refund or if the platform does not address the issue adequately, the next step is to escalate the complaint to a consumer protection authority. In India, consumers can file complaints through the National Consumer Helpline (NCH) or directly with the Consumer Court.
  • File a complaint with NCH or District Consumer Forum under the Consumer Protection Act, 2019, highlighting the misleading or false claims made by the health product.
  • If the product’s advertising falls under fraudulent practices, mention Section 2(1)(r) of the Consumer Protection Act, which deals with unfair trade practices.
  • In the U.S. or other countries:
    • File a complaint with the Federal Trade Commission (FTC) for misleading or deceptive advertising.
  • In the EU, you can report false health claims to the European Consumer Centre (ECC).

Notify Health and Regulatory Bodies

  • Health products are also regulated by government bodies that oversee product safety and advertising claims, like:

    • Drug Controller General of India (DCGI) for medicines and medical devices.

  • Regulatory bodies can investigate and take action against the company, such as penalties, warnings, or bans on the product.

File a Complaint with E-Commerce Platforms

  • If the product was purchased through an online marketplace (such as Amazon, Flipkart, or Snapdeal), many of these platforms have dedicated channels for reporting misleading products.
  • Use the platform’s customer service or complaints department to report the issue.
  • Ask for the seller to be removed from the platform or for the listing to be corrected to reflect the true nature of the product.
  • E-commerce platforms often have clear policies in place for misleading listings and are obligated to investigate the complaint.

Initiate Legal Action (If Necessary)

  • If the seller or platform fails to address the complaint or refuses a refund, you may want to consider legal action.
  • File a lawsuit for deceptive advertising or breach of contract in a consumer court.
  • Seek damages for financial loss, emotional distress, and any health risks incurred due to the false claims of the product.
  • Depending on the nature of the false claims, the manufacturer could also face criminal charges under Section 420 (cheating) or Section 468 (forgery) of the Indian Penal Code (IPC).

Legal Framework for False Claims on Online Health Products

Consumer Protection Act, 2019 (India)

  • Look for Certification: Ensure the product has certifications or approvals from relevant health authorities like FSSAI (India), FDA (U.S.), or other regulatory bodies.
  • Report Immediately: If you come across false health claims or suspect a product is misleading, report it immediately to the seller, platform, and relevant regulatory bodies.
  • Use Trusted Platforms: Purchase health products only from reliable and reputable platforms that prioritize consumer protection and adhere to advertising regulations.

  • A consumer purchases a weight-loss supplement advertised online with claims of rapid weight loss without the need for diet or exercise. After using the product, the consumer does not experience any weight loss, and after research, they find that the claims made by the seller are not scientifically supported.
