What Are The Steps Involved In Obtaining A Succession Certificate?

Answer By law4u team

A succession certificate is a legal document issued by a court that establishes the rightful heirs of a deceased person's property. The following is the process to obtain a succession certificate in India:

1. Application Filing

The interested party (heir) must file a petition for a succession certificate in the relevant district court. The application should include:

  • Details of the deceased, including name, date of death, and last address.
  • Information about the applicants (heirs) and their relationship to the deceased.
  • Details of the property for which the succession certificate is being sought.

2. Required Documents

Submit the following documents along with the application:

  • Death certificate of the deceased.
  • Identity proof and address proof of the applicants.
  • Affidavit stating the facts of the case.
  • Any other relevant documents that support the claim.

3. Court Fees

Pay the required court fees as per the applicable stamp duty for obtaining a succession certificate. The fee may vary based on the value of the property involved.

4. Court Hearing

The court will schedule a hearing to evaluate the application. During the hearing, the court may ask for additional information or documents, and all parties claiming a share in the property will be given an opportunity to present their case.

5. Issuance of Certificate

If the court is satisfied with the application and finds no objections, it will issue the succession certificate. This certificate serves as proof of the heir’s right to inherit the deceased’s property.

Summary

The process of obtaining a succession certificate involves filing an application in court, submitting necessary documents, paying court fees, attending a hearing, and receiving the certificate upon approval.
