Civil law provides individuals with a way to seek protection against domestic violence or abuse through restraining orders, also known as protective orders or orders of protection. These orders are legal documents issued by a court that prohibit an abuser from contacting or coming near the victim and can provide for other forms of protection as well. To obtain a restraining order, the victim must file a petition with the court and provide evidence of the abuse or violence. The court will then hold a hearing to determine whether the restraining order is warranted. If the court grants the restraining order, the abuser will be prohibited from contacting or coming near the victim and may be required to move out of the family home. The restraining order may also provide for other forms of protection, such as requiring the abuser to stay away from the victim's workplace or school. Civil law also provides criminal penalties for domestic violence and abuse. In cases where the abuser has committed a crime, such as assault or battery, criminal charges may be filed against them. The criminal justice system can provide additional protections for the victim, including orders of protection, mandatory counseling for the abuser, and jail time for the abuser if they are convicted. Overall, civil law provides individuals with a range of legal mechanisms to seek protection against domestic violence or abuse, including restraining orders and criminal penalties for the abuser. These legal mechanisms are designed to provide victims with the protection and support they need to escape abusive situations and move forward with their lives.
