No, a foreign citizen cannot file an RTI (Right to Information) application under Indian law. The Right to Information Act, 2005 clearly states that only citizens of India have the right to seek information from public authorities. The right under this Act is not extended to: Foreign nationals Non-Resident Indians (NRIs) who are no longer Indian citizens Foreign organizations or companies Even if a foreign citizen is residing in India, unless they hold Indian citizenship, they are not eligible to file an RTI application. However, if a foreign citizen requires information, they can try to: Obtain it through an Indian citizen acting on their behalf, or Access information already published online by public authorities under the Section 4 obligation of the RTI Act

Section 3 of the Right to Information Act provides as under: "Subject to the provisions of this Act, all citizens shall have the right to information."That means that the foreign citizen does have file for the same to the seek information.

Right to Information under the Right to Information Act is a right given to only Indian citizens. According to the provisions of Section 3 of the Act, "subject to the provisions of this Act, all citizens shall have the right to information." It clearly states that the Act does not provide such a right to foreign nationals and thus excludes them from submitting RTI applications.
