What is the maximum compensation a consumer court can award?

Under Indian law, the maximum compensation a Consumer Court can award depends on the pecuniary jurisdiction of the three-tier consumer dispute redressal system, as defined under the Consumer Protection Act, 2019. The limits are based on the value of the goods or services paid and the compensation claimed. Here is the current structure: District Consumer Disputes Redressal Commission (District Commission) Can entertain complaints where the value of goods or services paid as consideration does not exceed ₹50 lakh. Compensation awarded can be up to ₹50 lakh. State Consumer Disputes Redressal Commission (State Commission) Handles cases where the consideration exceeds ₹50 lakh but does not exceed ₹2 crore. Maximum compensation that can be awarded is up to ₹2 crore. National Consumer Disputes Redressal Commission (National Commission) Deals with complaints where the consideration exceeds ₹2 crore. Has no upper limit on the compensation it can award. Note: The "consideration" refers to the amount paid for the goods or services, not the value of damages claimed. However, compensation awarded can include: Refund of amount paid Replacement of goods or services Compensation for physical or mental harassment Litigation costs Punitive damages, if applicable

Dear Client, According to the 2019 Consumer Protection Act the jurisdiction of consumer commissions is determined by the claimed compensation and the value of the goods or services: District Commission: Up to 50000 Indian rupees. The State Commission: Over ₹50 lakh but under ₹2 crore. Greater than ₹2 crore for the National Commission. Therefore the maximum compensation is determined by the amount of the claim and the actual loss that the consumer has proven rather than being capped by law.
