क्या सर्वोच्च न्यायालय अवमानना के लिए दंड दे सकता है?

हाँ। भारत के सर्वोच्च न्यायालय को निम्नलिखित के तहत न्यायालय की अवमानना के लिए दंडित करने का अधिकार है: • संविधान का अनुच्छेद 129 – सर्वोच्च न्यायालय को एक "अभिलेख न्यायालय" घोषित करता है, जिसके पास अपनी अवमानना के लिए दंडित करने का अधिकार है। • न्यायालय की अवमानना अधिनियम, 1971 – अवमानना कानून को परिभाषित और विनियमित करता है। अवमानना के प्रकार • दीवानी अवमानना – न्यायालय के आदेश की जानबूझकर अवज्ञा या न्यायालय को दिए गए वचन का उल्लंघन। • आपराधिक अवमानना – ऐसे कार्य जो न्यायालय के अधिकार को कलंकित या कम करते हैं, न्यायिक कार्यवाही को प्रभावित करते हैं, या न्याय प्रशासन में बाधा डालते हैं। दंड उपलब्ध • 6 महीने तक का साधारण कारावास • ₹2,000 तक का जुर्माना • या दोनों (यदि अवमाननाकर्ता अपनी संतुष्टि के अनुसार क्षमा याचना कर ले तो न्यायालय दंड से मुक्त हो सकता है।) यह शक्ति स्वतंत्र है और संसद द्वारा इसे इस प्रकार सीमित नहीं किया जा सकता कि न्यायालय का संवैधानिक अधिकार समाप्त हो जाए।
