How to file GST returns?

Filing GST returns in India is a legal requirement for every registered taxpayer who has a GST number. The process is governed by the provisions of the Central Goods and Services Tax Act, 2017 and related rules. GST returns contain details of sales, purchases, tax collected, input tax credit claimed, and tax paid to the government. The basic process for filing GST returns starts with maintaining proper records of invoices and transactions during the tax period. After that the taxpayer must log in to the official GST portal using their GSTIN and credentials. The relevant return form must be selected based on the type of taxpayer. For example regular taxpayers generally file GSTR 1 for outward supplies and GSTR 3B for summary return and tax payment, while composition scheme taxpayers file different returns. The taxpayer must enter details of sales, purchases, tax liability, and input tax credit. The system may auto populate some information based on uploaded invoices. After verifying the details the return is submitted and tax payment is made if any liability is due. Finally the return is filed using digital signature, electronic verification code, or other approved methods. Returns must be filed within the prescribed due dates to avoid late fees, interest, and penalties. Even if there is no business activity during a period a nil return may still be required to maintain compliance.

Dear Client, Registered persons must submit their monthly tax returns according to Section 39(1) of the Central Goods and Services Tax Act 2017 (CGST Act) through the designated form which currently uses Form GSTR3B to comply with Rule 61 of the Central Goods and Services Tax Rules 2017 (CGST Rules) until the established deadline that applies to their specific taxpayer category. Section 37(1) of the CGST Act establishes that all registered individuals must submit their outward supply records through Form GSTR-1 which must comply with the timing and method requirements set by Rule 59 of the CGST Rules dedicated to QRMP taxpayers through the Invoice Furnishing Facility. Section 38 as it has been replaced now controls the process of sharing information about incoming products and tax credits while Section 44 requires certain registered users to complete an annual tax return using Form GSTR-9 except for those who qualify for exemptions found in the established provisos. The process of submitting GST returns requires taxpayers to begin by acquiring their GSTIN through Section 22 or 24 registration which they need to access the gst.gov.in common portal that Section 146 recognizes. After completing the registration process taxpayers need to enter the common portal through gst.gov.in which Section 146 recognizes to choose the appropriate return for their tax period. The taxpayer must present all their outbound supplies, all their inbound supplies subject to reverse charge, and their total eligible and ineligible input tax credits which they must report according to Chapter IX of the CGST Act. The taxpayer must settle their tax obligation by using input tax credits and making cash payments according to Section 49 and finally, the return has to be submitted with verification under Section 164 codified rules to avoid being subjected to any fees under Section 47 and interest under Section 50.
