Having proper documentation ensures the agreement is valid, enforceable, and protects the rights of both parties. The key documents required for a rent agreement include: Proof of Identity of the Landlord and Tenant: Documents such as Aadhaar card, PAN card, passport, voter ID, or driving license are used to verify the identities of both parties. Proof of Ownership of the Property: The landlord must provide evidence that they legally own the property being rented. Common documents include the sale deed, property tax receipt, or the latest electricity/water bill in the landlord’s name. Property Details: Documents showing the exact details of the property, such as survey number, property address, or building plan, are often attached to the agreement to avoid disputes. Photographs: Passport-sized photographs of both the landlord and tenant are usually affixed to the agreement to further authenticate the parties. NOC from the Housing Society (if applicable): If the property is part of a cooperative society or apartment complex, a No Objection Certificate (NOC) from the society or management may be required for renting it out. PAN Card of the Parties: In some states, providing PAN cards is mandatory, particularly if the rent exceeds ₹1 lakh per month, to comply with tax laws. Once these documents are collected, the rent agreement is drafted, specifying the rent amount, security deposit, tenure, rights, and responsibilities of both parties. The agreement must then be signed by both parties and witnesses. If the agreement is for a tenure exceeding 11 months, it is mandatory to register it with the local sub-registrar, which requires the payment of stamp duty and registration fees. Dear client, to make a rent agreement in India you need basic documents like ID proofs (that is Aadhaar, PAN card etc) of landlord and tenant, proof of property ownership (sales deed or tax bill) with property details and photos of both the parties. NOC from society may be required. The agreement should mention rent, deposit and terms and signed by both the parties and witnesses present and the registration is needed if the term exceeded 11 months.
