Dear Client, According to Indian law, the statute of limitations for bringing personal injury claims arising from a motor accident, will depend on the type of claim: 1. Previously there was a six-month limitation to file for compensation under the Motor Vehicles Act, 1988 under section 166(3). This provision was subsequently deleted by way of amendment in 1994. There is no limitation in the time period to file for a motor accident claim before the Motor Accident Claims Tribunal (MACT). It is recommended to file a claim as soon as possible to address evidentiary clashes, counterclaims, and the difficulty in locating witnesses. 2. For civil suits for personal injury or negligence cases, the limitation under the Limitation Act, 1963 is three years from the date of the accident or injury. In summary, while MACT claims technically have no limitation, courts prefer timely filing to ensure fair and effective adjudication. I hope this answer helps.
