Under the provisions of the Motor Vehicles Act, 1988, the courts in India recognize the loss of consortium as a non-pecuniary (non-monetary) loss, which is then awarded as part of the total compensation. The Supreme Court of India in National Insurance Co. Ltd. v. Pranay Sethi (2017), established the common amounts, the amounts awarded typically range from around ₹40,000 to ₹50,000 for each family member who qualifies, etc. Claims for loss of consortium claim are normally claimed before the Motor Accident Claims Tribunal (MACT) as part of other damages claimed such as loss of income, medical expenses, and pain and suffering.
