What Documents Are Required To Prove Eligibility For Interim Relief?

To obtain interim relief such as interim maintenance or protection orders, the claimant must provide sufficient documentary evidence to demonstrate their eligibility, financial need, relationship with the respondent, and urgency of relief.

Documents Required to Prove Eligibility for Interim Relief

1. Identity Proof

Aadhaar Card, PAN Card, Voter ID, Passport, or any government-issued ID to establish the claimant’s identity.

2. Relationship Proof

Marriage certificate, birth certificate of children, or affidavits to prove relationship with the respondent (e.g., spouse, child, dependent).

3. Residence Proof

Utility bills, ration card, rental agreement, or similar documents to show residence with or relation to the respondent or shared household.

4. Income Proof of Respondent

Salary slips, bank statements, income tax returns, Form 16, employer’s certificate, or affidavit of income to establish the respondent’s financial capacity.

5. Income Proof of Claimant

To show dependency or inability to maintain oneself, salary slips or bank statements may be furnished.

6. Affidavit or Written Statement

Detailing facts of the case, nature of dependency, financial hardship, and grounds for seeking interim relief.

7. Medical Reports (if applicable)

In cases involving domestic violence or health issues, medical certificates, injury reports, or police FIR copies can support urgency.

8. Legal Notices or Prior Complaints

Copies of complaints, police reports, or prior maintenance applications to show efforts made by the claimant.

9. Other Supporting Documents

School fee receipts, rent receipts, bills for essential expenses (medicines, utilities), or any other document substantiating financial need.

Scenario:
A woman applies for interim maintenance under the DV Act. The court asks her to submit documents proving her identity, marriage, residence, and her husband’s income.

Steps Taken:

  • She submits Aadhaar card, marriage certificate, and electricity bill as residence proof.
  • Provides salary slips and bank statements of her husband.
  • Files an affidavit describing her financial hardship and the need for interim maintenance.
  • Medical report attached showing injuries due to domestic violence.

The court evaluates documents and grants interim relief accordingly.
