  • Submit Evidence: Provide details of the defective product, including photographs, packaging, and the nature of the defect.
  • State Drugs Control Department: Each state has its own Drug Control Department which handles complaints about pharmaceutical products. You can approach the department for defective drugs or non-compliance with pharmaceutical regulations.

5. Lodge a Complaint with the Consumer Forum

Under the Consumer Protection Act, 2019, the forum handles disputes related to defective products and provides redress, including compensation for any loss or harm caused by defective goods.

  • Jurisdiction:
    • District Consumer Forum: For claims under ₹1 crore in value.
    • State Consumer Forum: For claims between ₹1 crore and ₹10 crore.

6. Seek Compensation for Harm

If the defective pharmaceutical product caused any health issues, such as a serious allergic reaction, hospitalization, or adverse side effects, the consumer can seek compensation for:

  • Medical Expenses: For treatment or hospitalization costs.
  • Pain and Suffering: For any physical harm or mental distress caused by the defect.
  • Loss of Earnings: If the health issue caused the consumer to miss work or business.
  • Example: If a defective drug led to hospitalization, the consumer can seek reimbursement for the medical costs and compensation for suffering.

7. Report to the National Pharmaceutical Pricing Authority (NPPA)

If the defect is related to pricing, such as overcharging for a pharmaceutical product, the consumer can report it to the National Pharmaceutical Pricing Authority (NPPA), which regulates drug prices in India.
