Can I File A Complaint Against Online Shopping Fraud?

With the rise of e-commerce, online shopping fraud has become a common issue. Consumers may face problems like non-delivery, receiving counterfeit or defective products, unauthorized payments, or misleading advertisements. Indian laws, including the Consumer Protection Act, 2019, and the Information Technology Act, 2000, provide mechanisms to file complaints and seek redressal.

Steps to File a Complaint Against Online Shopping Fraud

Collect Evidence

  • Keep order receipts, invoices, email confirmations, payment proof, chat transcripts, and screenshots of the online transaction.

Contact the Seller or Platform

  • Approach the e-commerce platform or seller first, requesting refund, replacement, or service correction.
  • Give them a written notice or complaint and keep a record of communication.

File Complaint with Consumer Forum

  • District Consumer Forum for claims up to ₹1 crore.
  • State Consumer Commission for claims above ₹1 crore but less than ₹10 crore.
  • National Consumer Commission for claims above ₹10 crore.
  • Complaints can be filed online via e-Daakhil portal or in person.

Include Specific Details

  • Mention nature of fraud (non-delivery, counterfeit, overcharging).
  • Attach all supporting documents and screenshots.
  • Clearly state relief sought (refund, replacement, compensation).

File Cybercrime Complaint (Optional but Recommended)

  • For fraud involving payment or theft of personal data, register a complaint with cybercrime.gov.in or local police.
  • This helps address criminal liability in addition to civil redressal.

Follow-Up and Hearing

  • Respond promptly to notices from the Consumer Forum.
  • Attend hearings and provide additional evidence if requested.

Legal Remedies Available

  • Refund of amount paid
  • Replacement of defective or counterfeit goods
  • Compensation for financial loss or inconvenience
  • Punitive action under cybercrime laws (IT Act 2000, Sections 66C, 66D, etc.)
  • Injunctions against fraudulent sellers to prevent further cheating

Example

Suppose a consumer orders a smartphone online for ₹40,000. The product never arrives, and repeated requests to the seller go unanswered.

Steps the consumer should take

  • Collect order confirmation, payment receipt, and screenshots of correspondence.
  • Notify the e-commerce platform requesting a refund.
  • File a complaint in the District Consumer Forum, attaching all evidence.
  • Optionally, report the seller on cybercrime.gov.in for online fraud.
  • Attend hearings; the forum may order the seller/platform to refund the full amount and pay compensation for inconvenience.
  • If dissatisfied with the decision, appeal to the State Consumer Commission.
