Under Indian law, maintenance rights of a Muslim wife are governed primarily by personal laws, the Muslim Women (Protection of Rights on Divorce) Act, 1986, and other relevant legal provisions. Below is a detailed breakdown: During Marriage Right to Maintenance A Muslim wife has the right to be maintained by her husband as long as she remains faithful, obeys reasonable marital obligations, and resides in the marital home unless there is a valid reason to live separately. Maintenance includes food, clothing, shelter, and other necessary expenses. Separate Residence If the husband neglects or refuses to maintain her without any lawful cause, the wife can claim maintenance even if she is living separately. Legal Recourse Under Section 125 of the Code of Criminal Procedure (CrPC), a Muslim wife can claim maintenance from her husband if he neglects or refuses to provide it, regardless of her religion. This section provides a remedy for destitute wives, irrespective of the personal laws. After Divorce Maintenance During Iddat Period Upon divorce, a Muslim husband is obligated to provide maintenance to his wife during the Iddat period (a waiting period of three months or, in case of pregnancy, until the child is born). Settlement Under The 1986 Act Under the Muslim Women (Protection of Rights on Divorce) Act, 1986, a divorced Muslim woman can claim: Maintenance for the Iddat period. A reasonable and fair provision for her future, which the husband must pay at the time of divorce. Payment of any unpaid mehr (dower). Maintenance for minor children until they are self-sufficient. If No Means of Support If a divorced Muslim woman has no means of support or relatives obligated to maintain her, she can approach the Magistrate for maintenance from the Wakf Board. Section 125 CrPC (Post-Danial Latifi Case) A divorced Muslim woman can still claim maintenance under Section 125 CrPC if she cannot maintain herself, provided it does not contradict provisions under the 1986 Act.
