What is the significance of Article 32 of the Indian Constitution?

Article 32 of the Indian Constitution is one of the most important fundamental rights, often called the “heart and soul” of the Constitution by Dr. B.R. Ambedkar. Here's its significance: It guarantees the right to constitutional remedies for the enforcement of fundamental rights. It empowers individuals to directly approach the Supreme Court if their fundamental rights are violated. It ensures judicial protection and enforcement of rights guaranteed under Part III of the Constitution. The Supreme Court can issue writs like habeas corpus, mandamus, prohibition, quo warranto, and certiorari to enforce rights. Key Points: Article 32 itself is a fundamental right. It acts as a check on arbitrary actions of the state. The Parliament cannot suspend Article 32, except during a national emergency (as per Article 359). In essence: Article 32 provides citizens with a powerful legal remedy to uphold and protect their fundamental rights against any violation by the State or its agencies.

Dear Client, Article 32 is referred to as the "heart and soul" of the Constitution because it enables people to approach the Supreme Court directly for the enforcement of their Fundamental Rights. It provides a guarantee of the right to constitutional remedies and is thus an effective means of safeguarding civil liberties. This Article authorizes the Supreme Court to issue writs such as habeas corpus, mandamus, and others to implement rights. It is itself a Fundamental Right, hence it can be enforced in the event of any infringement. Article 32 has an important function to maintain the rule of law. With the exception of national emergency (and that too, not necessarily), it cannot be suspended, giving testimony to its vital role in the constitutional order. I hope this answer helps.
